§1. Scope and Application

§1.1 General

These Terms of Service ("Terms") govern the provision of electronic services by Customer Connect CRM AB ("Customer Connect", "we", "us"), located at Patriks Väg 14, 434 90 Vallda, Sweden, registered under organisation number 559477-1114. Our services are accessible via customerconnect.io and its subdomains. These Terms comply with Swedish law and applicable consumer rights across the EU and international markets, including the United States.

§1.2 Consumer Rights

Local consumer protection laws in the consumer’s country of residence apply if they provide greater protection than these Terms.

§1.3 Privacy and Cookies

Our practices regarding personal data and cookies are outlined in our Privacy and Cookies Policy at customerconnect.io/en/privacy-policy.

§1.4 International Compliance

We comply with applicable data protection laws in the jurisdictions in which we operate, including but not limited to:

  • The General Data Protection Regulation (GDPR) in the EU.
  • The California Consumer Privacy Act (CCPA).
  • State-level privacy regulations in the United States (e.g., Virginia, Colorado, Connecticut, Utah).

§1.5 Business Use Only

Customer Connect is intended solely for business use. By using the Services, you confirm that you are acting on behalf of a business entity and not as a consumer under applicable consumer protection law.

§2. Definitions

  • Service: CRM and lead management software provided online.
  • Client: Legal entity or natural person conducting business activity subscribing to our services.
  • User: Individual authorized by the Client to access services.
  • Account: Individual login credentials for accessing services.
  • Pricing Plan: Subscription model with details at customerconnect.io/en/pricing.
  • Instance: Dedicated secure system space for Client use.
  • Licence: Right to use the Service under chosen Pricing Plan.

§3. Use of the Website and Services

3.1 User Responsibilities

Users must:

  • Provide accurate and truthful data.
  • Protect login credentials and regularly update passwords.
  • Respect third-party intellectual and privacy rights.

3.2 Prohibited Actions

Users must not:

  • Share passwords or provide unauthorized access.
  • Copy, modify, distribute, or commercially exploit content without authorization.
  • Introduce malicious software or data harmful to system infrastructure.

3.3 Prohibited Content

Users are prohibited from uploading or posting content that:

  • Violates any law or regulation.
  • Contains hate speech or incites violence.
  • Is discriminatory, harassing, or defamatory.
  • Is pornographic, obscene, or otherwise offensive.
  • Infringes intellectual property or personal rights of others.
  • Promotes or distributes malware or spam.
  • Facilitates fraudulent activity or impersonation.

3.4 Feedback and Suggestions

Any feedback, ideas, or suggestions you provide regarding the Services may be used by Customer Connect freely and without restriction. By submitting such feedback, you assign all intellectual property rights to us.

3.5 Brand Usage

Use of Customer Connect’s name, logo, or branding is prohibited without our prior written consent.

3.6 Monitoring

We reserve the right to monitor service usage to ensure compliance with these Terms and to enforce security.

§4. Provision of Services

4.1 Registration and Subscription

  • Agreements conclude electronically upon registration.
  • Accurate registration data is required.

4.2 Subscription Model

  • Services provided via subscriptions automatically renewing unless cancelled.
  • Subscription fees paid in advance through Stripe.

4.3 Payment Default

  • Overdue payments lead to notifications, suspension, and possible account deletion.

4.4 Cancellation by Client

  • Subscriptions cancellable anytime, with continued service until the end of the paid period.
  • Refunds for annual subscriptions only in exceptional circumstances approved by us.

4.5 Termination by Customer Connect

  • We reserve the right to terminate services upon Terms violations, with notifications and actions detailed above.

§5. Payment Methods

  • Payments processed securely via Stripe.
  • Alternative payment methods available upon request.
  • Non-transferable unused service quotas.

§7. Right of Withdrawal

  • Consumers may withdraw within 14 days.
  • Refunds issued within 14 days of withdrawal.
  • Exclusions apply to digital content already delivered or personalized services.

§8. Intellectual Property

  • All materials are proprietary.
  • Unauthorized use will result in legal consequences.

§9. Limitation of Liability

  • We are not liable for user misuse, incorrect data provided by users, temporary service interruptions for maintenance, or force majeure.

  • GDPR-compliant data protection practices detailed in our Privacy Policy.
  • We also adhere to applicable U.S. state privacy laws.

§11. Confidentiality

Each party agrees to keep confidential all proprietary or confidential information disclosed by the other, whether in writing or orally, that is designated as confidential or would reasonably be understood to be confidential. This includes customer data, financial data, business plans, and product information. Confidential information does not include information that becomes publicly known, was already known, or is required by law to be disclosed.

§12. Force Majeure

Customer Connect shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, acts of government, failure of suppliers or communication systems, or power failures. This does not affect the Client’s obligation to make timely payments.

§13. Arbitration (U.S. Users Only)

If you are located in the United States, you agree to resolve any dispute with Customer Connect through final and binding arbitration, except where otherwise required by law. Arbitration will take place in the State of Delaware under the rules of the American Arbitration Association. You may opt out of this arbitration clause within 30 days of accepting these Terms by sending an email to legal@customerconnect.io with your full name, business name, and a clear statement that you do not agree to arbitration.

§14. Final Provisions

We reserve the right to update these Terms, informing Users at least 7 days before changes. Consumer disputes resolved under local law; business disputes resolved under Swedish law unless otherwise agreed.
